Terms and Conditions – Nousch-Qi

This business is referred to below as "Nousch-Qi".

2. Scope

These terms and conditions apply to online purchases by consumers of:

• facial and body oils and other care products from Nousch-Qi;

• Evolve Organic Beauty skincare products;

• day retreats and workshops without overnight accommodation or transport, organised by Nousch-Qi.

A consumer is a natural person purchasing mainly for private purposes.

Customers can consult and save these terms before placing an order. The version applicable at the time of ordering remains applicable to that order.

Any specific conditions for an activity are clearly communicated before booking. They cannot restrict mandatory consumer rights.

Retreats qualifying as package travel require separate information and conditions in accordance with the applicable package travel legislation.

3. Offers and product information

For each product, we provide its main characteristics, contents or quantity, price, and relevant usage information. For activities, we specify details including the programme, date, location, price, and what is included.

Photographs are illustrative. Minor variations in colour, scent, or texture may occur with natural ingredients, provided they do not affect the safety, quality, or promised characteristics.

The description "handmade" does not automatically mean that a product is custom-made or excluded from the right of withdrawal.

Our offers are subject to the stated stock levels and available places. If an ordered product unexpectedly becomes unavailable, we inform the customer as soon as possible. A replacement product is supplied only with the customer's consent. If the order cannot be fulfilled, we refund the relevant amount.

4. Prices, orders, and payment

All prices are in euros and include applicable VAT. Delivery charges and any other mandatory costs are shown separately before the order is finalised.

Before ordering, the customer checks the order details and their contact and delivery information. The final order button clearly indicates that placing the order entails an obligation to pay.

The contract is concluded when the customer finalises the order and successfully completes the available payment procedure. Where payment by bank transfer or a deposit arrangement is expressly offered, the payment deadlines communicated in advance apply.

The customer receives an email confirmation containing the order, the applicable terms, and relevant information about withdrawal or cancellation.

Price changes after the contract has been concluded do not affect the agreed price.

5. Delivery and collection

Available delivery countries, shipping costs, and delivery times are communicated before ordering. Collection is possible where this option is offered during checkout.

Unless a different period has been expressly agreed, we deliver within thirty days of the conclusion of the contract.

We inform the customer of any delay. Statutory rights concerning late delivery remain applicable, including the right to terminate the contract after an appropriate additional delivery period. Where permitted by law, termination is possible without an additional period.

The risk of loss or damage remains with Nousch-Qi until the products are received by the customer or a third party designated by the customer, other than the carrier.

Please report an incorrect, damaged, or incomplete delivery as soon as possible using our email address, preferably including the order number and photographs. The absence of photographs or an immediate report does not automatically invalidate statutory rights.

6. Right of withdrawal for products

The customer may withdraw from an online product purchase without giving a reason within fourteen calendar days, starting on the day after receipt.

Where several products from a single order are delivered separately, this period starts on the day after receipt of the last product.

To exercise this right, the customer must send an unequivocal statement by email or post to Nousch-Qi before the period expires. The form at the end of these terms may be used, but is not compulsory. The online withdrawal function on our website may also be used.

After notifying us, the customer must return the products to the stated return address within fourteen calendar days.

The customer bears the direct cost of returning the products. Where an incorrect or defective product has been supplied, Nousch-Qi bears the necessary return costs.

Products must be handled carefully during the withdrawal period. The customer is liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics, and functioning of the products.

Returns must be securely packaged, using the original packaging where reasonably possible. The absence of the original packaging does not, in itself, exclude the right of withdrawal.

7. Refunds following withdrawal

If the customer withdraws from the entire order, we refund the purchase price and the cost of our least expensive standard delivery option. Additional charges for a more expensive delivery method chosen by the customer are not refunded.

Refunds are made within fourteen calendar days of receiving the withdrawal notification, using the same payment method, unless the customer expressly agrees to another method that does not incur any charges.

We may withhold the refund until we receive the products back or the customer provides evidence that they have been returned, whichever occurs first.

For a partial return, the original delivery costs are refunded only insofar as they relate exclusively to the returned portion of the order.

8. Exceptions to the right of withdrawal

The right of withdrawal does not apply to:

• sealed products that are unsuitable for return for health protection or hygiene reasons, where the seal has been broken after delivery;

• products genuinely made to individual specifications or clearly personalised.

These exceptions apply only where the statutory conditions are met. Where an exception applies, we communicate this before purchase.

Opening a shipping box is not the same as breaking a hygiene seal. Cosmetics are not automatically excluded from returns.

Rights relating to defective or incorrectly supplied products remain applicable, even where a relevant seal has been broken.

9. Use of care products

Our facial and body products are intended for cosmetic use in accordance with the instructions on the label and product page. They are not medicines and do not replace medical diagnosis or treatment.

Before use, read the ingredients, warnings, storage instructions, and shelf-life information. Do not use a product if you have a known allergy to any of its ingredients.

Natural ingredients and essential oils may also cause skin reactions. Stop using the product if irritation occurs and seek medical advice where necessary. Report adverse reactions to Nousch-Qi, preferably including the product name and batch number.

These usage instructions do not limit our statutory responsibility for safe and conforming products.

10. Statutory guarantee

Consumer goods are covered by the statutory two-year guarantee of conformity from the date of delivery.

This guarantee applies both to Nousch-Qi products and to Evolve Organic Beauty products purchased through our online shop. Customers may contact Nousch-Qi directly regarding this guarantee.

Please report any defect as soon as possible and no later than two months after discovering it.

In the event of a defect, the customer is entitled, under the statutory conditions, to repair or replacement free of charge and, where applicable, a price reduction or termination of the contract.

The statutory guarantee period does not mean that opened cosmetics have a shelf life of two years. Normal consumption, the stated shelf life, and correct storage remain relevant. An insufficient shelf life or a defect present at delivery may nevertheless fall within the statutory guarantee.

11. Day retreats and workshops

Before booking, the activity page specifies:

• the date, start and end times, and location;
• the programme;
• the price and what is included;
• any participation requirements;
• the payment arrangements;
• any minimum number of participants and the latest date on which the activity may be cancelled due to insufficient bookings.

For a day retreat or workshop constituting a leisure activity on a specific date or during a specific period, the statutory fourteen-day right of withdrawal does not apply. This is clearly stated before booking.

This exception does not automatically apply to an offer without a fixed date.

12. Cancellation of a day retreat or workshop by the customer

Cancellations must be made by email. The date on which Nousch-Qi receives the cancellation determines the applicable notice period.

Unless another reasonable arrangement has been expressly agreed before booking, the following applies:

• At least fourteen calendar days before the activity starts: a full refund.
• Fewer than fourteen calendar days before the activity starts: only reasonable, demonstrable costs and the actual net loss resulting from the cancellation may be charged, up to a maximum of the booking price.

When calculating this amount, we take account of costs saved and any resale of the available place. An explanation will be provided on request.

The customer may propose a replacement participant who meets the stated participation requirements. Nousch-Qi will not refuse the replacement without reasonable grounds. Any unavoidable costs associated with the change will be communicated in advance.

This arrangement does not affect mandatory statutory rights.

13. Cancellation or changes by Nousch-Qi

If Nousch-Qi cancels an activity, the customer receives a refund of the amount paid for that activity within fourteen calendar days. A credit voucher or an alternative date is offered only with the customer's agreement.

Cancellation due to insufficient participants is possible only in accordance with the minimum number and cancellation deadline communicated before booking.

Minor programme changes are possible provided the nature and quality of the activity are maintained.

In the event of a substantial change, such as a different date or a significantly altered programme, the customer may accept the change or cancel free of charge and receive a refund.

Any further statutory rights, including a right to compensation, remain unaffected.

14. Participation and liability

Our activities focus on wellbeing and relaxation. We do not promise specific medical or therapeutic outcomes.

Participants must follow safety instructions and respect their physical limits. Relevant limitations may be discussed confidentially in advance so that the suitability of activities can be assessed.

Nousch-Qi is liable in accordance with applicable law. These terms do not exclude any liability that cannot lawfully be excluded, including liability for intentional misconduct or gross negligence, and for death or personal injury.

Participation does not constitute a waiver of statutory rights.

15. Complaints and disputes

Complaints may be submitted using the email address stated in section 1. Please include an order or booking number and a description of the issue.

We respond to complaints within fourteen calendar days. If further investigation is needed, we inform the customer within that period when a substantive response can be expected.

If no solution is reached, the consumer may submit a request to the Belgian Consumer Mediation Service through https://consumentenombudsdienst.be. The service assesses whether the request falls within its remit.

The right to bring proceedings before a competent court remains unaffected.

16. Personal data

Nousch-Qi processes personal data as described in the separate privacy policy on the website.

Acceptance of these terms and conditions does not constitute consent to newsletters or other marketing requiring separate consent.

17. Applicable law

These contracts are governed by Belgian law.

This choice of law does not deprive consumers of the protection afforded by mandatory provisions of the law that would apply in the absence of this choice.

Disputes are handled by the courts having jurisdiction under the applicable legal rules.

If a provision is found to be invalid or unenforceable, the remaining provisions continue to apply insofar as the contract can remain in force without that provision.
